Facts, Sins to be established
Art. 12 The establishing the justification follows an example of it Facts which in this case require to be made known, and
for that purpose to be established by sufficient proof, in so far as obtainable
1. The state of destitution. N.B. if No then b the cause be excess
or imprudence inadvertence on the part of the functionary, this may be a sufficient
cause for punishing him with some less afflictive punishment
but not with death: which but for the supply in question might
have been his lot.
2. The refusal absence of all express inducement in the habitation in question verbal to afford the necessary supply:
