Equity Procedure — its magnitude confessed by
Master of the Rolls and Sugden
Morn.g Chron March 21st 1827.
Rolls' Court — Tuesday.
Hynne and others v. Hynne . . Mr Sugden observed,
that this case was well deserving of the attention of persons
in authority elsewhere. He had after declared on the floor
of that Court, and he would now repeat the declaration,
that the very existence of such a cause was a disgrace
to the Court. Here was a bill filed about 25 years ago,
and having originally no other object but the settlement
of an account, which, in consequence of the litigation
which had been so ruinously protracted, the tenant for
life was compelled to come to the Court to be fed, and, out
of his non estate, to ask, for his daily support, a pittance
which he obtained at an expense greater than could
be demanded for the loan of the same sum by the
most extortionate usurer in existence. These trustees
have, upon every such demand by the tenant for
life, come in to oppose him, and appeared by two
Solicitors, and two sets of Counsel, and had as effectually
destroyed the property of this man, as if they
had thrown it into the Thames. Some suggestion
having been made as to the best method of expediting
the cause.
The Master of the Rolls said, we must endeavour, by
some means or other to put an end to this suit. If
it continues much longer, there will be no property
left to quarrel about.
Mr Sugden. The continuance of such a suit, for
such a time, is absolutely disgraceful to the Court itself.
