Meantime, no sooner in the subject when evidence is on the carpet on the subject of evidence there is one heading
and all embracing consideration that presents itself at the first glance as covering
the subject in its the whole expanse of the subject at the first glance. This is
the force of the instant difficulties powerfulness of the obstacles which in all sorts of cases
oppose themselves to the obtaining the requisite and no more than the requisite the mass of evidence requisite
to the obtainment of a just decision to the administration
of substantial justice to the fulfilment of the predictions delivered
by the substantive branch of the law: to the preserving persuasion mind of the the Judge from
being led into a wrong channel by any false evidence should
any such happen to present itself. In many Sometimes
it will happen that although the facts calling for a decision
to a certain effect shall have taken place yet the evidence
necessary to establish constitute the ground for such decision
shall have been altogether wanting – shall never have presented
themselves to the observation nor so much as to the suspicion
of any human creature; or what comes to the same thing
to any p individual through whom of their existence
can have found its way to a person capable of taking the conception of a person able and willing to take upon
himself the function of a plaintiff, for the purpose of presenting
them to the cognizance of the Judge. In this case there
is no remedy: and on the other hand though in this case it
be too much to say, there is no mischief, yet by reason of the
absence of the main ingredient in the mischief of an offence
viz: the alarm, by far the greatest part of the mischief naturally
adherent to an offence will be have been kept for coming into
existence.
