Evidence

The object design – the ultimate object design – of this treatise, notwithstanding
the large proportion of matter of one a speculative
cast – of a cast to appearance purely speculative
included in it – is purely practical: viz: to discover ascertain
point out and prove the course proper to be taken under
each head of inquiry, by the legislator and under him
by the Judge, on the subject of Evidence as in relation
to every topic that can be found to be included within
the field of evidence. Though the object be practical
much speculative ground must
be travelled over e'er it be attained.

But the ends by which the consideration of the course to be taken
as above in relation to Evidence require to be governed are the same as the ends by the
consideration of which the course to be taken in relation
to Procedure require to be governed: in other words fundamental the
principles of regulation (meaning the proper fundamental principles) and decision on the subject of Evidence
are the same as the fundamental principles meaning the proper fundamental principles of regulation and
decision on the subject of Procedure.

If this be just, an exhibition of the fundamental
principles of procedure thus to contrast the (if the expression
may be thus abridged contracted) will be a necessary preliminary
to all disquisitions of detail on the subject of
Evidence.

Leaving to a future The disquisition concerning
the course proper to be taken in relation to such steps parts of
the field
in the career of procedure as do not concern the subject of evidence
will be the subject business of a separate work. : to which To which these will
be added for the reasons that will be mentioned presently, a certain
part of the disquisition concerning the course proper to be taken
in relation to the subject of procedure. Of this disquisition whatever
