Procedure

In the course of the glances that will come to be
taken at the existing systems of procedure, it will appear
but too plainly to whichever we turn our eyes – that it
is impossible the proper the indisputably proper ends of that system, should have
been steadily aimed at in practice, or even kept in view in theory, as shall in the
by-end and improper all along studiously and anxiously steadily pursued: the
constantly and when not purposely turned aside from, be most commonly forgotten
and neglected. We shall see immense vast masses of that
which is called law and so far justly in as much as
it has the coercive and vexatious power of law, the
formation of which may be traced to the neglect of the
proper ends, did I say traced to that cause, or rather may at the first word be seen
to have had no other.

In this as in every other practical art, with its correspondent mass of sources the delineation designation
of the ends that ought to be kept in view, and of the means
mot conducive to the attainment of them, may be considered
as the hornbook of the science: but if the this hornbook is well
made and full enough, it is a compleat treasure of the science
at the same time. Not to have done given this is to have done nothing:
but to have done it, and done it well, is to have
done every thing: The matter of the subject the stores of genius invention are exhausted: perfection
is attained.

In the contemplation of this is as of any other branch of art
or science, grudge not therefore – grudge not reader – whatever
pains may be necessary to the due correct conception of the
end: of the main end, including the subordinate branches ramifications into
which it may be necessary to divide it branch it out, and the several
connections relations and bearings of those branches – comparing each with all the rest one amongst another.
