3. Seeing or not seeing the evil, and intending the legislator intends to produce it, not as
contributing any thing by its own efficacy to the good in view, but as
an inseparable effect a co-effect irremediably inevitably resulting from the production
of that good. In this case the evil is a is neither mediately
nor directly, but may be said to be collaterally intentional. In
this case it comes under the notion of juridical vexation, and
where in all the case in which it is neither unnecessary nor
preponderant, the voluntary production of it being in this case only voluntary is, on the part of the legislator, in the principle
or utility, justifiable.
