In the catalogue of inconvenience of the first order as produced
by delay, no account has hitherto been taken but of
certain evils. But in the train of these certain evils come
a variety of contingencies. While delay runs on its course, parties
may die; evidences perish; solvency, the means of fund for defraying the
expence, be dissolved. Hence, besides the retardation of a
right decision, result so many chances in favour of a wrong
one: hence besides the temporary non-fulfilment of the
promises and other predictions of the substantive branch of the
law, may result – and too often do result – the
final breach of those promises – the final disfulfilment of
those predictions. Punishment and satisfaction may in this way fail
ultimately of being applied where due: rights, of being conferred
where due.

Nor is the plaintiff the only one of the parties to whose
prejudice delay may in this way be productive of inconvenience.
Punishment may thus come to be applied where
not due: satisfaction may come to be applied – its attendant
obligations consequently imposed – where not due,
rights may come to be conferred – its their attendant obligations
consequently imposed – where not due.

In the inconvenience of delay are therefore included
over and over again, and in all their variety of shapes,
– included without exception all the inconveniences of the first
order, as comprehended under the above six heads. Yet is are not
the mass of inconvenience how vast soever that is attendant in delay
there is not an atom of inconvenience which is not included in
one or other of those heads: so that, if strike off the inconvenience
of the first order were to vanish, delay would not in any shape be
productive of inconvenience.
