Evidence Introd.

The legitimate, the only legitimate all comprehensive general end of proc the system
of procedure is the general utility. The end indicated in
that character by the principle of utility – in a word
general utility in a word in so far as it applies
to the subject matter and functions of arrangements belonging to the system of procedure.
The interest corresponding to General utility is the interest of the whole community
to the exclusion of all any particular interests by
the pursuit of which a man would run counter to that
general end interest. But of any particular interest if exclusively
pursued, the pursuit will frequently run counter to
general interest.

In so far as the general interest fails of being exclusively
pursued by

The classes of persons by whose labour the exception
system of procedure established in any given country has
been constructed put together, are of two descriptions 1. persons
concerned in the business of legislation, say for shortness, the
legislature, and persons concerned in the business of judicature,
say for shortness in like manner the Judge. In so far as
either of them those persons has knowingly turned aside from the pursuit of
the general or legitimate interest, the force by which he has been
engaged to do so to do has necessarily been that of some
personal interest of his own, which in respect of the otherwise the line of conduct he is
eff pursuing would be a undue composed of acts without
motive, of effects without a cause. This particular interest
turning a man thus aside from the path prescribed by general interest
may well be termed a sinister interest, and the correspondent end
– the end termed – a sinister end.
