In the days of antient Rome, when the expulsion of the Kings
had left the body politic government political community in a sort of mixed state
made up of democracy, aristocracy and royalty – power in any shape unlimited a sort of confined
state, something betwixt anarchy and government the power of
judicature, fell as it were of its own accord, and without any
express and determinate law, into the hands of the members
of the aristocracy, the patricians. The two Consuls, in whom
the power of commanding the whole community for military purposes,
and thence for all purposes in general was reposed, had
found full occupation employment for their time in the exercise field of their
authority in the capacity of Generals: they had none left
for acting in the character of Judges. Force Those who had at their command the whole stock of physical force
not being at leisure to exert itself in this act upon the ground, it lay open and superiority of
having something else to do the field lay open for intellectual to knowledge
became a prize to intellectual superiority. Judicature, even in its rudest state, requires
some acquired skill, if it were only for the making memorandums:
memorandums of what passes in the day, to ground the proceedings of another. The patricians, the aristocracy, had a
smouldering look at those acquirements: the plebeians, the democracy, had
none at all: the patricians, deriving the means of subsistence
from sources other than that of the labour of their own hands,
had some leisure for obtaining those acquirements: time at command for acquiring the acquisition of those rare talents: the plebeians
had none at all no such leisure: a monopoly of the function of judicature
fell thus, as it were of itself, into the hands of the Patricians.
