§. 2. Model of forensic procedure, the domestic.

The architecture of nature gave the first model to the architecture of man.
Trunks become produced columns, branches, arcades arches: foliage leaves furnished the
ornaments for the architecture.

Family procedure gave the law to legal Domestic A political state is a family encreased and magnified: a
family is a State in miniature.

Families existed before States. Government in families existed before
government in States. Government is not less necessary to the existence of
families than of States. In the one as in the other, judicature is an
indispensable branch of government. It executes laws, so far as laws exist if there are laws:
if not it supplies though in a state most wretchedly the want of them, so far as they laws are wanting
it supplies though in a very miserably inadequate, the want of them.

In families as in states, in as in

In the large societies there will always be disputes disputes among the happen break out but too frequently: the
smallest have never been altogether how should it be otherwise: few indeed are the families, how small soever that are altogether free from them. Not only opposition
of interests, but even the different lights in which the same object
will sometimes present itself in to different understandings, are every where
sufficient to give birth to them those results. In the families there will every
now and then be transgressions acts offences of delinquency: transgressions of those rules of action conduct, which
with more or less reason, in a manner more or less explicit, the governing head
member has laid down for the observance of the rest. Such transgressions
are called offences misdeeds, acts of misbehaviour: be the will declared will command of the superior more or less reasonable
every act that runs counter to it them receives that name. Pain produced inflicted
purposely by the superior, the father, the head of the family whether for the purpose of preventing the repetition
of the offence, on the part of the same delinquent on the part of others
under exposed to the temptation to become delinquents, or merely to give vent to
the resentment produced in the mind raised in the breast of the superior by the contemplation
of the offence, receives alike the name of punishment.

All this, on the small scale of a family, exists in families:
all this, on the large scale of a State, exists in States.
