Evidence
If among the facts which constitute the ground of the
plaintiff's claim there be any for the proof of which did cause being
they not having been the subject of his own perceptions, he is
obliged to have recourse to extraneous testimony, the occasion
for presenting them is still the same, the only difference
being that now in so far they are his discourse wears the shape of
allegation instead of testimony. nable as to those facts
to speak in the way of knowledge, he is not the less able to speak
to those same facts in the the way of belief: but as
the extraneous witness must now be heard, as the persuasion
of the party not as to those have had any can not had no other ground than the supposed
perceptions of the extraneous witness, if any details
appear to be requisite, it is from the witness that they must
come, and in so far any thing of that sort from the
party himself would be superfluous and useless.
The party and his witness being thus present at
the same time, in this case here let it be observed, there is no on the
part of the party, unless the witness be a person suborned
mendacity on the part of the witness be expected and relied
upon, there is neither ruin nor temptation for insincerity:
no sinister point of any kind is to be gained by it, no
delay: for if the account given by the party of the testimony
about to be given by his witness is false, there the witness
is by whom it will immediately be contradicted: no expence
no vexation, by the burthen of which as in regular procedure the defendant might be
reasoned unable, or by the prospect of which deterred from it so much as
he attempt endeavour to defend himself.
