Ch. of §. The existing of Lawyers Judges, how far chargeable with the
existing abuses?

When an event or state of things is mentioned as having
had existence in time past, it is only in so far as it continues to exist its existence
is continued
exists either in itself or in its effects consequences in present time, that
it is worth thinking about with a any view to practice. But To account
for its existence in time present time, it is not sufficient to
account for its preservation creation, its preservation is another phenomenon that must also be
accounted for. But the In the present instance whatever causes served to account
for its preservati creation, the same causes will serve to account
for its preservation with still less difficulty. For creation
activity exertion is necessary: for preservation, vis inertia, mere inaction is sufficient.

In the ætiology of this state of things whatever the problem what
remains to be accounted for and explained, is – assuming the fact that for a
long time there has been no consideration of any increase in the magnitude
of the abuse, to what causes this stagnation, this stationary
condition of things is to be ascribed? Here too the answer
is not unobvious. The ages age, whatever it was in which the foundations of the
system were laid was a barbarous age: no eyes either
disposed or qualified or disposed to look into the abuse direct themselves to the mischief with a
view to the prevention, the stoppage, or the cure of it, writing since printing not in existence. For a considerable
length of time the public eye has had possessed a sufficient degree
both of probity and intelligence of vigilance, if not for the alleviation of much less for this cure of the mischief, yet at
any rate for the rendering the and considerable encrease of it impracticable.
