To say of any one system of procedure law much more of all every system
in the lump that in design it was no better than a system of depredation extortion
contrived for the benefit of the framers, that just has never been the real object
never any thing more than the collateral and casual result – to speak thus
wears bears at first view the air of satire.
But when on the other hand it is considered that any the smallest force, whether applied
to body or to mind without any thing to oppose it, is sure at last
be prod proved at last – that no man ever meddled with
the system whose interest it was not either to make it worse, or at least
to keep it from being made better – that there never has been any
single individual whose duty it has been to consider how it ought be
made better, or so much as how it might be from growing worse,
that there never has been a single individual who ever had any reason
to expect that an endeavour exertions of his in the view of shewing how it
might be made better would be find any better reception, if it good then followed by any thing better than
neglect, when these things are duly considered it will be found that a state of thing
the connotation of which had the air not only of satire but
of extravagance, is was so far from being other than true not merely the natural or rather the necessary
consequence of human nature placed in the situations in which the
fitness aptitude of the system with relation to its legitimate and proper ends
depended.
