Forgery (first-rate capital)
what

Forgery is where for lucre or out of malice a man
writes fabricates counterfeits any writing [or any thing to answer other mark
the purpose of a writing purporting to be the writing with design that it shall pass
of another, or produces for the writing or mark of
another person or as if it had been made at
another time or on another occasion than that on at which it purports
to have been made] or or endeavours to make it be
utters a falshood
by writing or any
other characters or tokens used
to express any particular
meaning

or procures any such counterfeit writing or other
mark to be made, or endeavours to make it pass
knowing it or having probable cause to believe it
to be made counterfeit endeavours to make it pass
for genuine.

Criminative Forgery to be punished by Retaliation like
Criminative Perjury.

Instructions concerning
Punishment

Let it be the care of the Judge that in no case
an offender profit by his offence See Ins. p.3.
Therefore all any persons who is convicted of any offence
may be compelled to confess upon oath what profit
he has made by it.

See Ins. p. 1 oppressors not to triumph.

Forgery
Means

Forgery to give credit to false intelligence whereby
the interest of the public may be asserted.
It may be by printing as well as writing — Instance Pretended letter of Ld Weymouth
stuck up near the change at London

Parricide Punishment
why extraordinary

I appoint this extraordinary punishment — 1. to
satisfy the public indignation (viz. of those who speculate) and contribute to the
popularity of the Code : [+] [+] To serve as the purpose of a moral
lesson by encreasing the
detestation of against the offence
3dly because the thought of perpetuating
of a murderer of this sort shews a man to be more
depraved and consequently to stand in need of a severe
punishment to restrain him than an ordinary murderer:
in other words it shews him to less sensible
to the influence of the moral sanction and therefore
it is necessary to make addition to the force of the
political.
