In determining what degree of violence or harm
shall be was necessary in the prosecution of any lawful
purpose by an act which otherwise would be a personal
injury allowance shall be made for the infirmity of human judgment. Accordingly it shall be consider'd not merely whether a
less harmful method of accomplishing the same purpose
might or might not occur to a person considering the case
in cool blood, but whether such a method did actually occur
to the person in the purturbation of mind he was in and appear equally practicable to him with that
which he actually
