Why no Laws against
Heresy

people, who by virtue of this privilege have the power in so far as it extends of setting him in enmity
and rebellion against any who are his sovereigns.
For that it right and as such enjoined by
God to rise up against and expell anyone's sovereign
that ever existed is a proposition much less which
let it be applied to what sovereign it will that
ever yet existed, is much less obviously repugnant
to reason than that the moon is constituted
of green cheese.

Procedure
Examination when
to be Secret

To prevent the mischief that might result from
an innocent culprit's being obliged to disclose family secrets in
the course of his examination, suppose upon his own
application he were at liberty to have the audience room
cleared? But then should there not be two Judges, to be a
check upon one another, least the if there be one only the criminal
should bribe him?

24
Examination of
the culprit whether
to extend to all offences

If the compulsory examination of the accused
would be too much to extend to all offences, Qu, whether
it might not be not extended to Theft, I extended
only to Robbery, Burglary Murder &

Make a list of offences to which it ought not to
be extended — It certainly ought not to abuse of the
venereal appetite not to Adultery, Fornication, Buggery &
Heresy.

Procedure
Apology for Checks
& on Judges

In the choice of precautions I take against private interest in Judges &c I endeavour to find out
such as would do against the worst of men: if they do
against thes
e, a priori not they against those that the best
are best.

The basis of all Jurisprudence is suspicion.
I never trust any thing to any man [Judge] but when
the case appears to be such that any further check that would
be applied would do more harm than good.

Secrecy (without the consent of the parties) is the inlet to partiality Secresy is the basis of Justice.
