Accessory offences, from the relation they bear
to the principal one in point of time may be
distinguished into principal preliminary
and evidentiary. Preliminary are such accessory
offences as are of a nature to precede the principal one: [+] [+] and thereby furnish
evidence of a
state of things in
which if not intercepted,
an offence
of the nature of the
principal one is
likely (it seems) to take place.
evidentiary
ones are such as shew it is thought,
that the principal one is actually either committing or
committed.

Offences how created
by punishment.

Whatever act the law punishes it usually in effect thereby prohibits:
and by in prohibiting it thereby constitutes

in any case it turns into an offence the act
whatever it be positive or negative which he committs
into or suffering himself to be in that case.
