All the Laws which concern the subjects of the 5th principal division
in the Table of the 4th Book of the Commentaries prefixed
to the Analysis, are Laws Adjective, so are those
which concern the Offences in number 22 and which are treated of in part of the 4th & in the 12th 13th 14th & 15th Chapters of that Book.. (all but two of them
the 8+ +8. Taking Rewards to help one to one's Stolen Goods. & the 9th ||
|| 9 Receiving Stolen Goods) which are arranged under the 3d principal division
in the same Table under the Title of Offences against
Justice; and are treated of in the 6th Chapter of the same
Book.

So are those which are comprized under the Division of
the Table to the 3d Book entitled "of the Pursuit of Remedies
& treated of in the 11th 12th 13th 14th 15th & 16th Chapters.

So the Forgery of
Titles.

As it may be observed that Laws concerning Offences Accessory
agree with Laws Adjective in this, that both kinds are appendicious
[to certain Principal ones] It will perhaps be
asked, how are they to be how may they be distinguished? It is answer'd by
their differing in the following respects.

First as to those differences by which Laws Adjective of both
kinds (namely as well as those the few which relate to Promulgation, as
the multitude which are subservient to Execution) are distinguished
in common from the species of Laws first mention'd —
Laws against Accessory Offences would not be fit to be made
unless certain other Acts Deeds besides which they constituted —
offences [by them+] + viz their Principals existed and were mischievous: but might
be made and have operation, tho' those Acts did not exist:
and might be made and by possibility be obey'd tho' they were
no other Laws in being beside themselves.

Laws Adjective could not so much as be made unless certain other Laws+
existed —

+viz these Substantive

In the first case it is certain Actions or doings that must
exist for certain others actions or doings to be mischievous:
in the last, it is certain Laws also that must exist relative
to those actions, for certain other Laws to find obedience be possible to be
obey'd.

This may perhaps be sufficient to give an Idea of the distinction
of the two Classes.
