Mala in Se — prohibita.
To believe [the writers on this subject and particularly] the Author of the Commentaries+
Law the passage v. some thing relating to it p.9 v.p.55 as well as any <add>other, Law
[by virtue of a certain Aliking] can turn make acts into crimes mischief that is [make these Acts] mischief
which are not so — If Laws have any such transmutatory a transmutative power, it we should be glad<add> [when they were above <add>it] they
would exercise it in making fewer mischiefs of the enough that we have already
rather than in making more [of them] — The truth is when all is done that these laws can do there are just
as many sorts of mischiefs Crimes in this as there were before, only are <add>unless it be that <add>now & then that by a little management
they [may] contrive [as they do sometimes] to make a few more of the old ones. Sprouting collaterally out of the new Laws
Observe the Contradiction — Mala prohibita are acts not wrong with motives [viz:
mischievous (for wrong to have any meaning can mean only either simply prohibited
as also mischievous) in themselves — They become are made wrong (mischievous) by Laws — Yet
these Laws are not binding upon Conscience.
