CH.... PARTS of a LAW - LAWS SUBSTANTIVE and ADJECTIVE
If we add "and the Sheriff shall execute him" that
is a remedial part, according to the first part of
it's Description.+
But this is a distinct Law, for it is
addressed to a different Object from the former, —
namely, a person under the limited Description of
Sheriff: it's directory part is a Command, whereas
that of the other was a Prohibition: and it has a
Sanction expressed either a long with it or apart
from it, which Sanction may be & commonly is different
from that of a principal one.
If we further add — "And the Persons robbed shall
have amends out of his Effects" this answers to the
Remedial Part, according to the remaining Clause
of its Description.
But this is nothing more than a Portion of
the sanctional part of the principal Law, which
being pecuniary is capable of being applied to the
purpose of Compensation to the one, as well as
of punishment to the other.
From what has been observed above we are
however furnished with a Distinction which will
