CH.... PARTS of a LAW - Laws SUBSTANTIVE and ADJECTIVE
be useful in Name because it occurs frequently
in Idea, of Laws into such as we have hitherto
called principal II II radical, and shall henceforth call Substantive,
and such others as we have hitherto called
accessory, and shall now call adjective+. + or Subservient
The first, agreeable to this Denomination,
are conceivable independently of ye second, and as such with how little
Efficacy soever, may exist. The second are not
conceivable independently of some one substantive
one, nor can exist. — "The Sheriff shall execute
him" is a Law which II is vain and devoid of
Signification till it be applied to the Substantive
Law preceding — "whoso robs shall be hanged"
Again the Nature of the Adjective Laws is
such as to be made to fit on to many Substantives.
As it may be — "whoso commits Murder he
shall be hanged and the Sheriff shall execute him
so also it may be "whoso commits Treason he
shall be hanged drawn and quartered: and the
Sheriff shall execute him" — and so on.
In Practice every Substantive Law has not
one
