CH.... PARTS of a LAW - Laws SUBSTANTIVES and ADJECTIVE
in the Stat. 9 G. 2. C.37. §8, which directs
that that Statute shall be hung up in the Workshops
of those Artizans whom it respects.
Laws Adjective are all such as either presented
the formalities of Judicial procedure, or by being grounded upon (necessarily)
suppose the existence of those formalities.
Laws Substantive are those which in matters
penal defend describe the offence, and compose assign <add>prescribe the Sanction
which+ + Where their function is to distribute [to do something
belonging appertaining to distribution] [in matters of distribution] perform the distribution
whatever it is whether of profit or of burthen
that is to be distributed. N.B. N.B. That the distinction holds obtains,
good as well with respect to Custom as to Statute Law are grounded upon
This won't do with regard to matters penal — For Laws Adjective must
defend some offence, & proscribe some sanction
Among Titles of Law, all those are Adjective in the
synopsis prescribed to Dr Blackstone's Analysis which
[Among of+] Statutes among those which which are composed wholly of
Laws of the Adjective kind are for example the several Statutes
of — The Statute for the Abbreviation of
Michaelmas term II II 16 Car 1. c.6. The several Statute's entitled
"for the Amendment of the Law. everything in
short which comes under belongs to the title of Procedure: For this a name
which tho' of no long standing in the one language, &
not yet introduced into the profession, I must beg leave
to apply all along to that title in preference to that of
Practise which tho' the only one in common use will
of in the many too narrow instances be found to be either ambiguous or
