Offences local & temporary are to be found only among that in the class of those which are
[in tendency] : those which are which are Principals viz: those of the two first classes of [accomplishment] are every where at all times + + at least in nations than any

What occasion the variation is, that in certain countries or districts an offence of in tendency limited
to an offence of accomplishment, which does not in certain other.
Thus in Great Britain, & most other Kingdoms carnal knowledge Defilement of a female allied in a certain degree to the Crown
has a tendency to produce Homicides and those other offences of accomplishment Miseries being all every one of them
such as are produced by some Principal offence of which are included in the complex term of War — because here it perplexes the right
of possession where the Succession is hereditary: In Poland it has no such tendency, here
it perplexes not that right, where the Kingdom is elective. But in Poland as in
Great Britain, & as in every country the mischief of Homicide is the same
Thus again on certain coast of Great Britain, it is penal to destroy a certain
plant by which by the network of its' roots entangles the Sands, and I forms them into an
a tremendous rampart against the Law: because such a destroying has a tendency to
promote an Inundation — It is not so in Berkshire or Buckinghamshire, because so
destroying has there no such tendency: but there as well as elsewhere, the mischief of
Inundation is alike the same.
