CLASSIFIC. INTRODUCTION. DIVISION FALSE — Private-Public
It might be expected & should I begin with Private Crimes — these being the Elements as it were
The effect in which the others terminate; & in which if they did not terminate, their
ambiguity would have no existence
out of which Public are composed — Just so that if the former
can well be conceived to exist without the latter, but the latter cannot
be conceived to exist without the former — [abstract the former
and you destroy the latter] The latter tho' respectively greater more considerable than
the other former are derivative from them if composed out of them: just
as the pleasures mental pleasure however superior are descriptive are found to derive by an analysis ultimately
their existence from physical, & abstraction made of them, to crumble
into vapor & so it would be in a science discovering the signification of the Terms Where the elementary
terms are part was unknown
The vulgar common/popular distinction between Public & Private crimes
it appears plainly, was taken nothing not from any thing in the
nature of the offences themselves, belonging to bearing any relation to the offence but merely from the
local positive & accidental fortuitous circumstances of these latter being
prosecuted in the name of the representative of the
Public & of the penalty where pecuniary accruing to his
benefit [in that capacity] as an undeniable proof
it may be observed that the self-same offence in a great
variety of instances, acquits these two [contradistinct] opposite questions denominations
