3 Classes.

The source of distinction between the 3 Classes
is in the object: of it viz: a difference observable
respecting the persons who are the
objects of, who are exposed to suffer by the
several acts offences which constituting the articles
arranged under these respective classes.

1st Class

+ are &c [enumerate them.]

In the 1st Class, these which constitute
the 1st order,+ they agree 1st In the spaces seat
of the pain immediately produced by them II and
in the subject of the action which is person.
: which is the body
2d They agree in some measure in the physical
appearance of the acts: in the sense+
exhibited by those acts: + or groups of images

They disagree 1st in the consequences of the first
pain: 2dly In the external instrument of pain: and
in the internal organ.

2d Class.

Those which constitute the 2d Class agree
1st In the seat of the pain produced
by them: [which viz: is] the mind: in which
they stand distinguished from those of the
1st 2d In the quality of the pain: viz.
a pain of privation: 3d in the subject matter
of the action viz: property

resemblance & diversity

In Offences the points of congruity
and diversity are as follows

1st The Physical Phases or appearance
of the act constituted an offence: The sense which it exhibits: The image
which it excites.

2d The person of the object, i.e: the person against
whom it+ is committed. v.4.

3d The subject viz: of the action: the
thing, or corporeal substance, if there is
any, upon which it is committed.
This may either be the same as
the object or different: that is it may
either be a person or a King: and
if a person either the same person who is
the object, or some other.

4. In the seat in the object of the pain produced by
them: which is either body or
mind.

5. In the quantity certainty of the mischief produced
by them which makes it either 1st
Pain, or 2dly Danger.

6. In the external instrument of pain.

7. In the internal organ.

8. In this certainty of the object, whether 1st
determinable individually: 2dly locally or 3dly
not at all.

9. In the political circumstances of the
object viz: 1st Authority 2d Rank. 3d Riches.

10. In the consent or non consent of the
person who is the object.

11. In the motive to of the offence.

12. In the number of joint-offenders.

13. In the place where the offence was
committed. Burglary. Domestic Theft
Highway Robbery.
