Instances of Unnatural Classification in the Vagrant
Act.

1st Idle and disorderly persons. 2d Rogues
and vagabonds. 3dly Incorrigible rogues.
Names taken not from the nature of
the respective offences, but from the judgment
passed upon them respecting the
punishment + + thought meet
for them. they are thought to
demand.

One thing is plain: These names can give no idea of the
several offences. They suppose an each idea
already formed. [They convey no better a
description of the sorts of person, guilty of them than if the Legislator
had said] Three sorts of persons said a Legislator once, I
have marked out for punishment. The
man I hate a little: the man I hate
more — and the man I hate most. Malefactors
go and recognize yourselves, + + which if you
swear who you
are go find yourselves out Judges,
Officers go and find out malefactors, by this description.

What more is it
that it says by
the division distinction
of [the] offences [it ? enumerates]
What better
or other description
of the sorts of persons
guilty of them does
it give?

It was evident, that [to have said] thus much, and no more [if
nothing more ] were said, was] were as good as
[saying] nothing. Accordingly it was found
necessary to character ascertain the several sorts
of persons thus distinguished, by descriptions,
characterizing them by the nature of their
respective acts.

Of these acts, several as different in their
nature as can be easily be conceived imagined
are lumped packed together within the same denomination:
and the punishment being
following appointed according to the denomination
are marked out denoted to in consequence for the same punishment.

One of the offences that come Under the first of these classes

[one of the offences is] the an [offence ] that]
consists in carrying exercise a part kind of
trade or occupation which it is thought
proper to prohibit: an occupation
which so far as it is exercised is so
far from demonstrating a man idle
and disorderly, that it denominates him
industrious. If this be a species of industry
that it is not thought fit to
tolerate that is a another quite different affair. consideration

The same sorts of Pain as are produced
by Offences of the 1st class (and no others)
are those which are produced by Offences
of the second and third classes. Their
Mischiefs one or more of them produced
by offences of that class are the Elements
of the Mischief produced by one of this.
