some such sense Classification is the comprizing of many articles under one principal denomination
That their appellation & their properties may be
so extensive and no more with their properties
Nomenclature is the applying it's specific denomination to each Article in
particular. — Both these operations therefore being in fact but the same operation [only
performed only upon subjects differing only in Extent, will be properly treated on together.

It is not to be done with the Nomenclature
of the Law
The reformation of the Nomenclature is here a necessary appendage to a natural classification.
The old Forms constitute a groupe of so many particular & unnatural classifications spreading
over across & allsworth the whole subject & invincibly impeding the longer they subsist the natural System in its arrangement from developing itself.
The Title should serve as an Index to the
properties — That Property from whence
Tables thus are respectively assumed
as is mode of operation.
More positive regulations having nothing to lead to them & standing insulated are difficult
to remember — instance in the niceties concerning forfeiture & deodand corruption of blood and
Treason & Felony & to whom the forfeiture in the 1st case is to accrue & in what cases.

Nomenclature & it's divisions
The Vocabulary is itself a
Lesson it at once indicates
distributes justifies fixes and
explains — once established upon
a natural & conspicuous basis principle, it stands a perpetual barrier against the sallies invasions of Ignorance, Tyranny & Caprice
It will serve remain as a test whereby to try all other Systems.
As in Natural History that is the most advantageous of (as the Term is,) the most Natural mode of
Classification which distinguishes each Article from the rest all others by those properties that property whereby it at once most
differs from the rest, contrasted with those others and most readily engages Man's attention, So is it in Jurisprudence Now in Natural
History as well as every other Science, that gravity whereby it affects our respects their Happiness would be that which men would choose
to characterise name & classify it by in preference
to every other, because they should be most sure of its' being that whereby it should them all were it not that there in the 1st place

In many no such quality perhaps exists: 2dly In many it does
in the little Where it does exist, it lies hidden, & does not appear
to on the first view: 3dly being the same in a multitude of Articles it cannot serve thereby to distinguish one from another: so that on the
some, it can only serve for a classical denomination from which it is incapacitated by the 2 former circumstances; Now lastly some
are
comprized under
Jurisprudence this quality of affecting man's happiness is of the very essence of its Articles, & belongs
to them all that are genuine & by proper notification may be made to appear at first view; the mode of Classification
taken from those qualities is here attended with equal advantage & peculiar facility
The order of their degree will
unhappily interfere with the order of
their making
There must be two Tables one
a Classification one of one other against Justice & against Individuals
Two methods of arrangement — one taken from the degree, the quantity of
respectively
produced by virtues — the other from their Quality — from the nature & subject — another
of the respective energies which produce them.
My endeavour is will be to place the System in as many different points of view as possible so/ [to enable the] that the
Eye of the observer to may to be or able to penetrate it with care & rapiddity in all directions.

The the principal The use of Nomenclature Classification & nomenclature is that apose Sight of the term the idea may present
itself
The manner in which they affect men's happiness will mark out the outline, & serve for
their Classification; the mode of their operation will fill up that outline, & give their specific Nomenclature.
A man will too often find the
Language rebellious under his hands
It befalls/wills against & disgorges error
A man has been guilty of felony — What is it he has done? What are the Crimes of some one of which he has been guilty?
Now upon hearing that a man had been Guilty of Felony I would venture
to defy the most experienced practitioner or most whether he would Judge to answer me then the question what
the man had done? [so of Premunire.] To say nothing of Felonies within Clergy
no memory I believe so exercised & vigorous as to be able to recall by the most severe
exertions in any length of time without recurring to paper all the 150 crimes or thereabouts to which which rank under
the name of unchrgyable Felony [is attributed]. I leave it then to any one
to determine what possibility whether it be possible there can be of any one's passing such a simultaneous
glance across the whole line group as to have as to possess the whole as to excite in any himself so many
distinct ideas forming so many branches of the alternative —
chain series of alternatives.
The reader will at once see
that there are offences & that
there can be no others
it is curious to observe how so
have observed any words whose origin was either
arbitrary from the first, or lost
in the depths of an obscure antiquity
which its familiar signification are absorbed all the
familiar norms related to it
has so nearly come of centers of
Abstraction about which
exaggerated & charging offences
have found themselves as High Treason, Felony, Premunire
The only tolerably precise Idea of which the Term is susceptible is that which
belongs to it in it's original signification of a punishment: and it is that accordingly
that exclusively presents itself [to the word] upon its being mentioned: so that when it is said
that any such an one is guilty of Felony without saying any thing of Clergy either the one way or the
other, the Idea convey'd to the hearer is of an indeterminate
something which there is a being hanged for.
