ACCOMPLICES. APHORISMS.

X An accessory persuading advising to be deemed guilty the Principal to committ one Crime, who committs another,
to Suffer as for that crime the commission of which he advised.

An accessory advising one to committ one a Crime on one thing or against one object person who commit in consequence
of that advice Committs it the same crime on another to suffer for that Crime

A receiver of goods valuables taken possessed unlawfully
is an Accessory to
that Crime whereby they were
taken possessed.

If one man procures another advises/persuades or assists or encourages another [who procures advises or
encourages a third (& so on to any number of questions Removes) to committ a Crime
they are all accessories to that Crime

If the Crime which a man procures advises or encourages to do is not done, but
some other crime in consequence of that advice procurement encouragement or advice is the procurer &c shall
suffer the punishment of the Crime not done committed if less than that of the crime committed;
if greater or equal; that of the crime committed.

This to be applied to Intention
where the same person intends

+ Whoso instigates persuades to one crime so that another crime is committed in consequence
of such instigation persuasion shall suffer as for the punishment of the first crime if less than that of the
crime committed if one seems of greater or equal || || contra Post. 370. §§ 3.

An Accomplice is one who instigates to or assists in a Crime committed,
at or before it's commission.

The absence of Criminal intention
in the Principal excuseth him, but excuseth not
the Accessory & vice versa

Criminals are either Principals or Accomplices —
The punishment 2 for 6 both 7 is 3 the 4 same 5

An Accessory is he who assists persuades
a Principal in to or persuades assists him
other to in the committing of
a Crime or of an act which
would be a crime if done by
the Criminal with a criminal
intention.

A Principal is he who actually committs the Crime —
The Crimes susceptible of Accomplices to be enumerated in the Code.

Qu. where a man means to
lend an assistance to one crime
which by means of assistance another is
committed — as if he holds a
man who he for another to rob him, &
that other murders him?

Did he instigate to any other crime? Answ. Yes
What is that crime? — Answ. Larceny Theft [for instance]
Was that Crime committed in consequence of his instigation? Answ. Yes
Instigate includes counselling advising commanding encouraging procuring; & is a term pretty well known to the
people as well as to the Law by its' perpetual occurrence in Indictments for those Crimes which
are [charged to be] committed "by or the instigation of the Devil" or Qu. 'Persuade'
