I give this division only as a clue to the cases which have already arisen or may hereafter arise
under the Law as it stands at present: for it is evident [upon the principal here adopted] that
in all these cases the Punishment, for the obno Crime [which] result[ing] from the obnoxious act
if when it is completely unintentional, being in all these cases equally out of contemplation must be equally
useless, & even though it were useful, yet as being disproportionate would be inexpedient. †is

& th of these cases it may in one view in a gross way of phrasing/mode of phraseology be said to be difficult to know when
the Punishment would be useless or no, because it would be difficult to know whether it were
the obnoxious crime resulting from the intentionality of the obnoxious act or some other short of it
that was in contemplation, yet from the moment the part of the branch of the alternative being once negatived by
the verdict of the Jury, it is becomes, as clear in this case that the Punishment of that crime would be useless
& that the case matter/incident comes within this class of exemption, as in any other.
