§. Semi-public offences

Semi-public offences
affecting person and
property – in these
two cases, the degree
of evil produced,
altogether different.

In the case of the
person, the greater the
number affected; the
greater the evil of
suffering.

In the case of property,
the magnitude
of evil the same,
the greater the number
of persons, the
less the aggregate
suffering.
4.
This the principle,
in English law, of
the transference of
damage done to an
individual, to the
whole of the inhabitants
of the Country.
5.
The same observations
apply to public
offences.
6.
In an offence against
person and property
together, so much
suffering as regards
person is increased,
and so much as regards
property is diminished,
by the number
of persons injured:
diminished in ratio
of the number of
persons to one.
