Division of Offences
Nomenclation of Offences
1
Doctrine of offences
the nosology of the
body politic – the
rest of the Penal
Code & Procedure
Code the Therapeutics
2
This comparison
not a matter of
mere ornament but
productive of great
elucidation in its
details.
3
As to denominations
the legislator Raving
found a separate
conception of each
moral evil encountered
by a prohibition so many prohibitions
so many offences
his conception of the
several aggregates
present a demand
for the formation of
correspondent denominations
as expressive
as possible.
For this purpose
rules are as follows.

The list of denominations
should be
all comprehensive

reason whatsoever

5
Rule 2nd. Each denomination
should be clear
& distinct.
6
Rule 3. It should be
familiar to
interested.
7
Rule 4 – This not being
possible all denominations
which are clear
distinct & familiar
should be employed
8
Rule 5 – In this case
of such denominations
no need of expositions.
9

In every community
however redundant
it is also incomplete.
12
Acts demanding
prohibition have
escaped legislators
notice.
13
Of prohibited acts
a still greater number
have received no denomination
& the idea
can only be gathered
from a large assemblage
of hetergeneous
words.
14
Rule 11 – Single worded
denominations
when in use either
were familiar when
adopted or have become
so since.
15
But scarcely anyone
to be fond sufficiently
clear to dispense with
exposition & at the
same time scarce an
Exposition to be found.
16
Remains to be provided
a list of Acts to
be qualified as offences.
17
So of acts requiring
denominations.
