§. Source Extent of the Division
Ch.
1
Offences are either
affecting immediately
the person of the
sufferer or by the
intervention of exterior
objects.

The person consists
of body & mind
which maybe affected
both at once or
separately,
3
Body & mind together
may be affected
in respect of the active
or of the passive faculties.
4
The active faculties
by restraint or by
constraint.

Offences respecting the
miscellaneous & detailed
right to prevent
burdens may affect
person & reputation
or person & property.

mutuality
or reciprocity now place
the wronged & wronger
are perfectly distinct
& the case is comparatively
single.

Not so where mutuality
& reciprocity have
place the two parties
bearing mutually a
legal relationship
termed condition of
life & arising for the
most part out of some part
of the natural modes
of relationship.

Each such Condition
is considered as a benefit
in virtue of the
rights & powers conferred
as a burthen
in virtue of the obligation
imposed. In so
far as considered as a
benefit in possession or

to take it off or to
escape from it.

denominations for the
two clusters of offences
