Ch. III. Division of Offences

1.
Offences inchoate and
consummate – a groupe
including preparation
attempt and consummation.

2.
Characteristic property
in each groupe, the
common result of
all those is one and
the same evil of the
1st. order.

3.
Not but that each
one may produce
an evil of the 1st. order.

4.
Danger will depend
on the magnitude
of the evil of the 1st.
order.

5.
The alarm from the
attempt or preparation
will be of the same
sort as that from the
evil of the 1st. order,
but not so vivid as
if the offence were
consummated.

Example, homicide.
In case of an attempt,
the danger of repetition
may be as great as in
the case of consummation.
Not so the degree
of alarm.

If but one evil result
from the whole, where
the use of distinction?
Ans. The greater the
number of acts distinguished,
the greater
that of the acts to wh.
evidence may apply,
and the greater the probability
of appropriate
remedies being applied.

Suppose that, in the
attempt, evil intention
is perceptible – this enables
the application of
preliminary preventive
remedies.

9.
Preparation in so
far as regards evil
of the 2d. order, not
very different from
attempts.

10.
The importance of
legislative operation
may be seen to be
caused by the surface
they present for the
application of preventive
remedies.

11.
Accordingly, acts of
preparation have not
been altogether neglected
by the most unskilful legislator.
Example, in contrabandism
prohibited
fabrication, importation,
exportation.
