Nuisance Penal CodeCh. II Offences affg. person & property

24. A butcher, brewer &c
uses his trade in a convenient
place, though
it be
to the annoyance
of his neighbour.

25. A builds a house &
makes upon his
soil, whereby B's house
newly built in an adjoining
soil falls down.

26. – or by such building
stop lights newly made in
the house of another –
such lights continued for
30 or 40 years.

27. Two houses built
nearly at the same time
and purchased of the
same proprietor A & B of the two – A.
obstructs B's lights by
adding to his tenement.

28. A. makes a ditch
in his waste, which
lies near the highway,
(34 feet off ) B's house
falls therein.

29. Or, in London, erects
upon an ancient foundation
an edifice which obstructs
the antient lights
of the adjoining house.

30. – or use water in
his own land out of a
water course running
through his land to the
ponds of B. whereby B's

pond is not so full.

31. A. had lights in an
antient house, and he
rebuilds the house &
makes lights in other
places and larger to the
inconvenience of the plff.

32. Common Nuisance,
but no special damage.

33. A makes a ditch in
a highway, whereby B.
cannot use it.

34. A stops common
ferry.

35. A makes a ditch in
the highway, and B's horse
falls into it.

36. B's servant falls in
and maims himself.

37. A puts logs in the
highway, and B's horse
falls over them.

38. By stopping he highway,
B. is constrained
to use a longer and more
difficult way.

39. A. stops the way, whereby
the sale of coals is
hindered in an adjacent
colliery – or by obstruction
of the sale the
coals are damnified.
