[If] It is an Anecdote handed down to us bef By the Anonymous Author of the Preface to the Book of Reports which goes by the Title of 5th Modern. The celebrated Serjeant Maynard, by the Anonymous a man in whose character composition, (if we trust
to the description of it believe character handed down to us with examples to confirm it by a party-rival) his the public
merits which are so well known were allied with a competent share of professional &
selfish cunning, that "in citing a case taken by himself 50 years he told the Court he desired the Court to
take notice my Author that it was of as good Authority as any that had been printed since which
observes my Author "takes in every Report of my Lord Coke's". Yet Now these Reports the
best of his works as containing the least of the Author that is original, are still looked
upon and were much more then, as the very Anchor of the Science profession. If these then are then
so useful (might one have said to him) that venerable Vestor of the Law), as you cannot but confess they are, why not
benefit the public by publishing your's which you say are as good as they? He knew better + + he was not wanting in that wisdom which his Ancestors had Nature had taught to his Predecessors & has since taught to those that have succeeded him possessed before him, & his Successors have possessed since.

And to speak in general it is a remark circumstance not unworthy of observation, that of all that prodigious number of
how few scarce one except beside L. Coke and a few hirelings chiefly anonymous for bread, have made the given the public benefit
of their useful collections but involuntarily after their death, or if voluntarily
not till after their arrival at that station where the exclusive possession of them would
be profitable no longer.

These considerations may perhaps help us to the one reason why the memory of this institution
so often recalled,+ + Blackst Comm: Berrington Pref. to 5th Mod. has been so to so little purpose.

A necessity, the exe determ which the Judges determining from a full possession of all every materials and a systematical veto of every consequence were very well warranted to pronounce, but of which an obscure practise had nothing to lead him into the track of anticipating the determination. For what purpose plant an Index to warn him of a pitfall, if it is to be kept cover'd up from his observation.

All this is said, on the supposition that in all such instances the predilection for a particular form has been founded on utility, that is in this behalf on the necessary regard to one or other of the three purposes of Certainty. How much more forcibly does it apply to the too numerous instances where it has may be seen to have had no better foundation than habitual prejudice or caprice? Caprice the which dictates to investigate by anticipation is a task to which of which baffles all sagacity to To adduce write down all the cases which contribute to justify this observation would be to write a Volume for the purpose of illustrating it. I shall I make use of the first making that comes to hand.
