| HIGH TREASON

It is a Crime the first in magnitude: but it is a Crime only
as it includes
in it's customary & probable consequences Many Arsons, Many Murders, many Burglaries & many Robberies & many Rapes,
that is much of that unhappiness which is produced by the Acts so technically
denominated, & the production of which it is alone that makes them worthy if
our attention — that is to say +
+ Sudden & deprivation
of the instruments of every
kind of happiness, sudden
orphanage sudden widowhood
sudden loss of friends
imprisonment contumely & pain

sudden poverty upon many
& the terror of all these sudden
evils constantly depending
over all.

Hence were it possible to conceive an High Treason
that should probably not give occasion to any of these, or giving occasion to some should
give occasion to fewer than would be produced without it, we must either say in
both cases that it is no High Treason or being such is in the first case indifferent,
in the other latter meritorious. An observation which may at first sight
appear to favor the doctrine of passive obedience, & evince the
inexpediency of resisting by arms force the only ultimately efficacious method of
to any established kind of Tyranny. But does not For what Tyrant may it be said, at least what modern
Tyrant ever occasioned so great a proportion of those sufferings by his cruelties
and his exactions, so much past, & so great a loss of the materials of pleasure
as were the actual or at least the probable consequences of the War enter into
to make their case? Perhaps none, were the corporal & material sufferings
alone to be taken into the account, especially if the consideration of duration were to be omitted
out of the question But it is to be consider'd that and both these case of the mischief is
as well as the remedy, the material sufferings, if I may be allowed the expression,
in a country people tolerably civilized as modern Europe, where the cruelties of the victors have their Round form relatively but a small
proportion of the complex mass of misery in either.

It is evident that some such confused Ballance
between the experiences & the modes as this more or less accurate
recording to the different
degrees of passion or prudence
is made by every man terribly stricken thinking previous
to his engagement in an enterprise
of this sort, however quaint
& — the accurate methodical/open
expression of it may appear here
