Neither High Constables nor Petty subscribe the
Declaration against Transubstantiation; nor receive
the Sacrament: nor do Petty Constables so much
as take the Oaths of Allegiance, Supremacy
or Abjuration.
34.
The only light in which the Penal Laws against
Papists are supported is that of instruments of defense:
ready to be plaid off against them in
case of any commotions on their part. There is
no one that wishes, at least as one that
professes to wish, but that, so that we could be secure
against their encroachments, they might
worship God in after their manner without disturbance.
Not but that their conversion is on every account
most earnestly to be wished for: but that persecution,
'to the lengths we could bring ourselves to carry
it, is acknowledged' by all to be as a means as
unsuitable to the end, as flagitious in itself.
35.
Yet is there not a man of that persuasion of in the
Kingdom but who might either be made to lose suffer
his life Death or at least be subjected to such punishments such punishments as must

must as must necessarily end in his punishment
and in exile at the good pleasure of any one
man if any one such there be in the whole
Kingdom where either a mistaken zeal or
the veter emotion of lucre could convert into an
instrument of the Law.
35.
Propose therefore that the on in default of other
expedients 1 That all Rewards to the
informer be abolished. 2. That a discretionary
power be given to the Grand Jury to determine
as well concerning the fact, as whether there is
honorable evidence or as produced before them, as concerning
the policy, whether supposing the evidence
sufficient, the charge shall be received.
