without a vitious evill is no crime at all. So
that to constitute crime against human Laws
there must be, first, a vitious evill; and secondly
an unlawful act consequent upon such vitious
evill — In vain then is the benefit of a Trial
by a Jury pretended permitted to be allowed to the supposed
offender, whom the only circumstance
upon which his guilt [in fact] depends is not
left to them to decide upon — If facts circumstances / matters, about
which there is seldom any difficulty or dispute
as the fact of publication, and the application to the persons supposed to be
