But this Punishment is not any punishment
whatsoever: it is a Acertain Punishment:
either fixed, or at least circumscribed
within certain limits.

Here then is one species of offence: that of
contributing to a Punishment on quantity
or quality not legal.

And these ends are not to be [employed]
contributed to by any means: but only by a particular
course of means, which as being
the P, deemed the best upon the whole + the
Law has marked out for that purpose:
The powers given him are cut and fashioned
to that course.

either a Nor to judge of what he is doing, they must with him: It is nothard:=it is something to follow

But he may offends also by mere non-feasance; he may offend by not taking upon him
to exercise powers which he is permitted to
exercise: in such case it appears, he is
not only permitted to exercise them, but enjoined.
He needed not perhaps to have exercised
them if he had not chosen: but he has
engaged to execute them: The Law depends
upon him to in the contingencies causes which call for it exercising them; if he had not
undertaken it, The Law would have committed them to some one else <add>(that)</add> some one else would.:
but to trusting to him it has not: that some
one else therefore will act, for he cannot:
& he does not: but the exercise of these
powers was necessary to the accomplishing
of the end: if they are not exercised, the
end can't not be accomplished: they are
not exercised: & so the end is not accomplished.

But the accomplishment of that end, and the instance
in question, was one of the means deemed
necessary to keep a certain portion of unhappiness mischief

from existing invading in the Society. There is therefore
a visible probability of a certain portion
of unhappinessmischief according to the Society; which
probability perhaps is bound converted into act[uality]
And he is the means of his its' accruing: Others
in his situation seeing in his punishment
the consequence of their permitting of and
like manner to accrue, will therefore be
induced to take the proper measures to prevent thereof he omitted, its
accruing: He is therefore a fit object of
Punishment.
