This head extends not to any of those animals, of which
while the use is regulated by the Statutes which relate to
them, the community is preserved: a qualified community
the abolition of which is so long as it is not general, will
serve to draw a clear line of distinction between the particular
subjects which it extends to and every other.
The 5 Subjects which we have had occasion to consider
the Deer, the Rabbit, the Pigeon, the Swan with the
whole tribe of Fish present a peculiar facility to this—
abolition — Three by the gregariousness of their Nature
the Deer, the Rabbit & the Pigeon of which the first
also by it's bulk. The second by it's attachment to the— same habitation: the Third by that circumstance joined
to the familiarity of which it may be brought with man.
the fourth by the last mentioned circumstances joined to
that of their bulk aided by an artificial check to their
faculty of flying— the last by the impassable boundaries
which, in some places nature, others Art, have fixed
to the element in which they live.

The Punishments annexed to the unlawful taking of
these animals are in general considerably superior to
what it would be necessary appoint for Thefts of other
property to the same amount.
