However this be, this much is certain, that by a Stat. 11 . H.7.17. The "taking" of the
eggs is prohibited order on pain of Imprisonment for a year & a day and arbitrary fine.
& by an absurd anticlimax, the offences the taking, together with the destroying is subjected by the S..27.2 to these lesser penalties which we have
seen established by that Statute for the Stealing or destroying of Pidgeons with respect to Pidgeons.
I have mentioned taken action of these Statutes , because tho' tho' it was not the design of them the establishment of
an exclusive
property in Swan's eggs was not their design , yet they will naturally in the prohibition be reasoned to the first by express provision & the latter by general words including the owner of the Land himself <add>& of the transfer</add>
for the protecting that exclusive property which every one in possession of the
parent Birds would naturally be disposed to in the offspring.
