LARCENY — Conies 3

Last of all comes a Statute of very recent date, that of the 5th of the present
5 G.3.14. Reign c.14 by the 6th Section of which, after such a Preamblular part as might
be expected, the penalty is augmented to Transportation for 7 years, in the case (to which only it extends) of the offence
being committed in the night time, or any lesser punishment by whipping fines or imprisonment at the + || discretion of that
and that as well on persons "aiding and assisting", or on the second date actors.

Adjective provision
+ To be tried before Justices of
1 year & Tomorrow or General Gaol
Delivery — that is — at that Assizes
only in very other County but now Modified
by the next Section, it
makes pro guards against doubles conviction

By the keeping on foot of
Harmonicorial Statutes with
penalties of different severity
the power of mitigation is
entrusted neither with the Judge
nor the Jury, but the prosecutor.
