[(D) Extends] Consent—how much it serves to Justify. Consent is not lawful cause for purposely occasioning the party a greater pain or uneasiness than it
is to be presumed, had he foreseen the probability of it,
he would have consented to take his chance for.

Justification 2d. Medical Practice.

Any thing done to a man in the view of benefiting
him in point of health is no injury done with lawful cause although it be done
without his consent; or even against his consent: provided
that in both cases it be successful, and more proper upon the whole than any
other that was about to be applied. As if a man be bitten
in the finger by a dog known to be mad; and you, to
save him from the infection, seize him; and in spite of his
resistance cut if off. If, by the opinion of persons expert
in medicine, it should appear that the dog was (unquestionably) mad; that in such a case immediate amputation
is a certain cure; and that it is not adviseable to trust
to any other; what you have done to him is no injury done with lawful cause.. See
