Justification 4.th — Defence. Instruction to the Legislator — Analytical View.
Analytical View. What is done in defence is done either in defence of
one's self, or in defence of a third person; and the attack is either
against the person or body of the party, or his possessions.
Main Text.
Defence of one's own Person To save one's self against an unlawful assault+ + or attack which
cannot be repelled with less mischief (A) to the assailant, any
thing done to his person is done with lawful cause: and the
party assaulted is not bound to save himself by yielding
ground.
Exposition.
Course to be taken in defending one's Self. [(A) Less mischief] 1. As if your adversary, having unlawfully
stricken struck you or having aimed a blow at you, persists in behaving
in such a manner as gives you probable cause for apprehending
