C
Of Justifications Reasons

Part IV

Why practise precaution against calamity (without consent)
is made a ground of justification?

Reason

Because punishment in this case would be groundless
See Introd. Ch [Cases unmeet & c]By the supposition
the act done to in this view is not
mischievous upon the whole. It is true that in
your judgement it may have appeared mischievous:
but such judgement of yours is by the supposition
a mistaken one. If not, the reason
does not hold good: nor therefore does the case
afford a ground of justification. It may however
afford a ground of extenuation see Tit.
Of Extenuations.

Quest. V

Why medical practice is made a ground of justification?

Reasons

1. Because punishment in this case would be
groundless. See above Quest. IV.

Quest VI

Why self defence against an unlawful attack
is made a ground of justification.
1. Because punishment in this case would not only be
groundless: but in every other: see Introd. Ch. [Cases unmeet & c] but
in every other respect pernicious. [ib.]
