Of Excuses Extenuations

Pleading an extenuation,

Excuse, or setting forth or Pleading an Extenuation, what
alledging an Excuse hearing extenuation, is the allegation of any
circumstance to which the law has given the property of rendering an offence less penal than it would be otherwise which renders an offence less penal
than it would be otherwise. (----)

The term Excuse Extenuation is herein after employed Extenuation for
for shortness instead of saying, ground of the Excusetenuation "ground of Excusetenuation"

A ground of Excuse Extenuation is any circumstance
the existence of which when applied to any the offence act in A ground of ExcuseExtenuation what
question, brings it within one of the cases in
which the punishment provided for the act, is or
may be such as to fall short more or less of the
punishment otherwise appointed for the offence.

The effect of a ground of ExcuseExtenuation is accordingly
to indicate the propriety of remitting a - its effect
greater or a lesser part or possibly, if the Judge
in his discretion think fit, even the whole of the
punishment otherwise appointed.

An extenuative circumstance or circumstance An extenuating circumstance
of extenuation is the same thing with a
ground of Excuse extenuation.

Extenuations are either general or special. General
are applicable to all offences, special to certain offences only.
