Of Excuses Extenuations
Main Text
The Excuse Extenuation which is afforded by a mis-supposal with Extenuative force of a mis-supposal in matter of law how measured.
regard to the matter of Law is the more compleat in proportion
as the probability is the greater that the party without
any default (A) of his fell into such mistake.
[(A) Default] As if the Defendant were a foreigner, unacquainted with the Language of the Law: or As if the Law relative to the subject matter in
question happened to be obscure with relation to the point
in question; or as if the party he were but just returned from
abroad, and during his year</del> his absence a ground of justification,
which had before been established, had been abrogated: or
as if a lawyer by profession, or the party's the Defendant's Father, Guardian
or Preceptor husband or any other person whom upon he had reason
to think well informed, had assured him you him or her that such

It is an Excuse Extenuation if the act be engaged in during a fit of
intoxication (A); provided the intention was not formed till after
