Of Simple Compound Injuries Extenuations

Extenuations are either general or special. General
are applicable to all offences:
special to certain offences only.
Special extenuations dismissed
For The several special extenuations are exhibited
under the heads of the several offences to which they
respectively belong. See the Table of Extenuations.
Extenuations apply to aggravations
Extenuations apply to aggravations as well
as to the original offences.
The three first extenuations take away extra-punishment
Where the three first general extenuation, to
wit want of intention, ignorance of the law, and
innocence of intention do apply any of them apply
no extra pain to any an aggravation, no specific extra-punishment
shall be applied.
An Infra-punishment
Any lesser punishment which on account of
an extenuation is substituted in the room of an ordinary
or an extra-punishment is termed an infra-punishment.
Infra-punishments specific and remissive
Infra-punishments are either specific or
remissive: specific are those which differ from the
ordinary or extra-punishment in kind as well as
in degree: remissive those which differ in degree
only.
