C 7 Of Extenuations — Reasons

2. Because a man's putting himself in a condition
in which he is liable to become mischievous
to society is a kind of behaviour
which demands some degree of blame. All men
it is true are not mischievous in their cups: but if he
is one of those who are, he ought to be have made himself acquainted
with his own temperament; and,
in the first place either forbear to intoxicate
himself, or if intoxication has stolen upon him
unawares, he ought while he retains in some
degree the use of his reason, to provide against
the danger. He may at any rate either retire
to rest or put himself under the guidance of
somebody who is sober.

Why compulsion [by menacement] is made
a ground of extenuation?

Reasons

1. Because the case may often be such, in
which punishment would be inefficacious. See
Tit. [Of Exemptions] Sect. X. Quest. 1. It must be so,
whensoever the certainty of the threaten'd mischief
seems entire, and the magnitude of it
greater than that of the ordinary punishment for the offence.
