C Of Simple Personal Injuries
[For a simple &c] Otherwise thus
For a simple personal injury the offenders
punishment shall be as follows
1. Fine. This at discretion. (Or this at option.)
2. Imprisonment— This also at discretion.
3. Giving security for good behaviour. This also
at discretion. or this the same.
4. Banishment from the presence of the party injured
for a certain time. This the same.
Where instead of [may] the word is [shall] there
instead of saying [This at discretion] the direction
may be [This at all events.] or [This at any rate.]
The like various lections may be applied
to each succeeding title. For another example See
Tit. Theft.
This formulary in itself seems to be better
of the two as being equally clear perspicuous and unambiguous
and more concise. But perhaps it is not applicable
with like advantage to all cases. Qu. wont it be better then
wont it be better to adopt it for the sake of the
improvement of these particular uses to which it
is applicable with advantage, or to reject it for
the sake of the uniformity of the whole.
